Rental Terms and Conditions
TERMS & CONDITIONS OF HIRE
These terms and conditions are to be read in conjunction with any rental document issued by Castle Cameras, to which they apply. The term “hirer” refers to the customer who is hiring the equipment from Castle Cameras.
1. Hire Period
1.1 - Hire periods start from a 1 day hire basis. You may collect your equipment from Castle Cameras premises after 3pm on the day before your hire date and must return the equipment by 9am on the day after your hire period (There is a two hour grace period for returns. If any item is returned later than 11am, you will be liable pay another full day rental). For example, you want to hire a lens for an event on the 2nd of the month. You may collect your equipment after 3pm on the 1st of the month and must return it at 9am on the 3rd of the month. A one-week hire is any seven-day period timed as above. A special rate of 5 days hire is applied to a one-week hire. A special weekend rate of 1.5 days hire applies when equipment is collected after 3pm on a Friday and returned by 9am on the Monday following. This period is charged at a rate of 1.5 day’s hire. If the Monday should be a Bank Holiday, the rate remains 1.5 days. If equipment is collected after 3pm on a Saturday and returned by 9am on the Monday following, 1 days rental fee will apply.
1.2 - Equipment may only be collected and returned in person to and from a Castle Cameras branch. Equipment cannot be couriered or delivered at this time.
1.3 - Equipment returned after the two hour grace period which ends at 11am on the agreed date of return will incur a late penalty charge of one full day’s rental cost without exception.
1.4 - Early returns made within the agreed hire period will not be subject to any refund to the customer, partial or full.
2.1 - Every effort has been made to ensure that the equipment is in full working order when it leaves Castle Cameras’ premises. Castle Cameras will accept no responsibility for any loss or damage whatsoever and howsoever arising from any failure, use or mis-use of the equipment, nor for any consequential loss arising there from.
2.2 - Castle Cameras recommends that the Hirer make their own checks and tests of the equipment before use, particularly before important assignments or foreign travel. If the equipment should fail during the rental period, Castle Cameras will endeavor to provide a replacement or similar item as soon as possible, but cannot guarantee to do so. It is recommended that in the case of important, costly assignments, Hirers should indemnify themselves against loss due to failure of hired equipment. It is assumed that the Hirer has sufficient skill and knowledge to operate the hired equipment correctly.
3. Deposits and Payment
3.1 - Castle Cameras shall at it discretion, require the Hirer to leave a security deposit equal to the full replacement cost of the equipment at the time of hire. This can be in the form of cash, bank or building society draft, or credit card. Castle Cameras reserves the right to encase such deposit in the event the Hirer defaults on any of these conditions. Castle Cameras shall, at its discretion, waive the deposit requirement for account holding customers.
3.2 - A booking deposit of £10 is required when booking any item in advance either in person, via telephone or e-mail. This deposit is deducted from the total hire price when collecting the rental item from our store. Items can be booked up to one month in advance. At least 72 hours notice is required for any hire cancellation to ensure return of the deposit. Hire bookings cancelled within 72 hours will result the deposit becoming forfeit.
3.3 - Payment for items hired is required in full at the time of collection, minus the booking deposit. No exceptions. Payment can only be made by either a credit or debit card.
3.4 - Castle Cameras will record full payment details from the Hirer at the time of rental including the CVV number. These details will be stored in a secure location in accordance with the data protection act, until such time that the Hirer returns the items in good working order. Once satisfied, Castle Cameras will securely destroy the card details.
3.5 - Castle Cameras reserves the right to change hire prices on equipment at any time without notice. Please be aware of this when reserving items.
4. Losses and Damage
4.1 -The Hirer shall be responsible for the return of the equipment to Castle Cameras at the agreed time, in the condition in which it was released to the Hirer, and with all accompanying accessories.
4.2 - The Hirer will be responsible for any damage or loss to the equipment including but not limited to theft, accidental damage, Force Majeure including but not limited to acts of God, war, flood, fire, labour disputes, strikes, sub-contractors, lock-outs, riots, civil commotion, malicious damage, explosion, terrorism, governmental actions, and any other similar.
4.3 - LOSS: in the event of loss or theft of part or all of the equipment hired whilst in the care of the Hirer, the replacement cost will be deducted from the security deposit or will be invoiced and charged in full to Hirer using the retained payment information provided at the time of booking.
4.4 - DAMAGE: in the event of damage or breakage including permanent marks to lenses and filter glass suffered during the hire, the Hirer will be charged for repairs. This to be deducted from the deposit or invoiced and charged in full to Hirer using the retained payment information provided at the time of booking. Damage in transit shall be the responsibility of the Hirer.
4.5 - In the event of loss or theft of the equipment during the hire period, the Hirer must inform both the Police and Castle Cameras at the earliest opportunity, and a Police report will be required for insurance purposes. In the event of damage to the equipment, the Hirer shall inform Castle Cameras at the earliest opportunity.
5.1 - All equipment hired must be covered by valid insurance. This is the responsibility of the hirer. All equipment taken abroad must be carried as hand-baggage, and no unattended or unexplained losses will be admitted.
5.2 - The hirer shall have a duty of care to take all reasonable precautions to keep the equipment secure and in their possession at all times. Failure to do so, or any negligence on the part of the hirer will result in the replacement value of the equipment being invoiced and charged in full to Hirer using the retained payment information provided at the time of booking.
6.1 - Equipment is hired and bookings are accepted subject to availability. If equipment that has been booked becomes unavailable through no fault of Castle Cameras, then Castle Cameras will endeavor to provide similar equipment at the agreed time, but cannot guarantee to do so.
6.2 - Availability of equipment to honour bookings made depends upon the prompt return of the equipment from the previous Hirer; in the event of failure to return hired equipment at the agreed time during your hire, Castle Cameras reserves the right to charge a full daily rate for each day or part of day that it remains overdue.
6.3 - In the event that equipment is returned damaged through mis-use by the Hirer, then Castle Cameras reserves the right to charge the Hirer any lost rental fees due to the equipment being out of service, in addition to the repair costs as detailed in section 4.
6.4 - In the event of total computer system failure in store, we may be unable to release hire equipment without access to our records. In this event we cannot guarantee you will be able to hire any equipment you may have booked until systems are restored.
7.1 - The Hirer should check the rental agreement carefully to ensure that all listed accessories are present upon collection of the equipment. Any accessories not present when the equipment is returned will automatically be charged to the Hirer.
8.1 - If you do not have a rental account with us you will need to create one before commencement of any hire. ALL accounts must be created at our Winton branch in person.
8.2 - To create your account you will need to bring with you a valid form of photo ID (driving license or passport) and a utility bill or bank statement dated within the last three months with your current home address. Creating the account takes about 10 minutes, so you can come in on the day you rent to set it up. If you do not have an account, you cannot hire out equipment. No exceptions.
8.3 - Castle Cameras will be able to use the Hirers account details as part of an investigation into any loss of equipment that might occur or in any perceived breach of these terms and conditions.
8.4 - Rentals can be collected from our Salisbury store, however please let the Winton store know (01202 526606) if you wish to do this as all hire equipment is held at our Winton branch. Please let us know as soon as possible if you require this service, as we will need to arrange transit to Salisbury.
Acceptance of the equipment for hire will be taken to signify acceptance by the Hirer of these terms and conditions. Any decision by Castle Cameras to waive any condition or requirement under any hire agreement will not in any way prejudice Castle Cameras’ rights under any other term or condition of the agreement.
